# Meta's 2026 WhatsApp AI policy: what business chatbots may do

> From 15 January 2026, Meta's WhatsApp Business terms bar AI providers from offering general-purpose AI assistants, such as ChatGPT-style bots, over the WhatsApp Business API. Businesses that use AI to answer their own customers about their own products, orders and services are not the target, but must still follow WhatsApp's messaging policy.

- The new rule targets AI providers whose AI assistant is the main product offered on WhatsApp, not shops using AI for customer service.
- A shop bot that answers about its own products, delivery and orders is incidental AI, which Meta's terms do not prohibit.
- WhatsApp's messaging policy still requires a clear path to a human when you use automation.
- Opt-in, the 24-hour window and template rules apply to AI replies exactly as they apply to human ones.
- Meta decides what counts as ‘primary’ functionality, so keep your bot focused on your own business.

In October 2025, headlines started saying "WhatsApp bans AI chatbots". For a shop owner in Dhaka, the obvious question follows: will the bot that answers "price koto?" on my WhatsApp number stop working in January?

Short answer: no, if it is a bot for your own business. The rule that takes effect on 15 January 2026 is aimed at a specific group, AI companies offering general-purpose assistants through the WhatsApp Business API. This post explains what changed, what a shop's chatbot may still do, and the rules that applied before and still apply now.

## What is Meta changing on 15 January 2026?

From 15 January 2026, Meta's terms for the WhatsApp Business Platform prohibit AI providers from using the platform to offer their AI technology when that AI is the primary functionality being offered. In plain words: you cannot run a public "chat with our AI about anything" assistant on the WhatsApp Business API.

The rule sits in a section called "AI Providers" in the [Meta Terms for WhatsApp Business Platform](https://www.facebook.com/legal/Meta-Terms-for-WhatsApp-Business-Platform). It covers providers and developers of AI and machine learning technology, including large language models and generative AI platforms, as Meta determines. The key phrase is that the ban applies when the AI is the "primary (rather than incidental or ancillary)" functionality. Meta decides which side of that line a service falls on.

Several general AI assistants that had public WhatsApp numbers announced they would stop working on WhatsApp after the date. Meta's stated reason was that the Business API is meant for businesses talking to their customers, not for hosting general chat assistants.

## Does the new rule affect my shop's AI chatbot?

No, a shop's AI chatbot that answers its own customers about its own business is not the target of the rule. For a shop, the AI is incidental: the thing on offer is clothes, phones or cosmetics, and the AI is how you answer questions about them.

The table shows where common uses fall.

| Use of AI on WhatsApp | How it looks under the AI Providers rule |
|---|---|
| A shop bot answering price, size and delivery questions | Customer service for the shop's own business; not the target |
| A bot that takes cash-on-delivery orders for the shop | Sales for the shop's own business; not the target |
| A clinic or coaching centre answering enquiries about its services | Business-specific support; not the target |
| A public number where anyone can ask a general AI anything | General-purpose assistant; prohibited for AI providers |
| A shop bot that also writes essays, poems or homework answers | Drifts towards general-purpose; avoid it |

The last row is the practical lesson. Keep your bot about your business. If a customer asks it to write a CV or explain world history, it should politely bring the chat back to your shop. That keeps you clearly on the right side of the line, and it also stops the bot from making things up on subjects you never gave it content for.

## Which WhatsApp rules already apply to AI chatbots?

The rules that matter most for a shop's AI were in place before 2026 and are unchanged: escalation to a human, opt-in, the 24-hour window, templates and limits on sensitive data. The new AI clause is an addition, not a replacement.

| Rule | What it means for an AI chatbot | Source |
|---|---|---|
| Escalation path | When you use automation, people must have a prompt, clear and direct way to reach a human or other support | WhatsApp Business Messaging Policy |
| Opt-in | Business-initiated messages go only to people who gave their number and opted in | WhatsApp Business Messaging Policy |
| 24-hour window | Free-form replies, AI or human, only within 24 hours of the customer's last message | WhatsApp Business Platform |
| Templates | Outside the window, only approved [message templates](https://salemag.net/glossary/message-template) | WhatsApp Business Platform |
| Sensitive data | Do not ask for full card numbers or financial account numbers in chat | WhatsApp Business Messaging Policy |
| Platform data and AI training | Platform data may not be used to train AI models in general | Meta Terms for WhatsApp Business Platform |

The escalation rule deserves the most attention. The [WhatsApp Business Messaging Policy](https://whatsappbusiness.com/policy/) allows automation but requires "prompt, clear, and direct escalation paths", and lists options such as in-chat transfer to a human agent, a phone number, email, web support or a support form. A bot that loops customers forever with "Sorry, I didn't understand" does not meet that standard. Our explainer on [human handover](https://salemag.net/glossary/human-handover) covers what a good escalation looks like.

## What should a business chatbot still be allowed to do?

A business chatbot may still answer customers about your products, services and orders, take orders, and pass hard chats to people, as long as it stays focused on your business and follows the messaging policy. In practice, for a Bangladeshi shop:

- Answer "dam koto?", "XL ache?", "Dhakar baire charge koto?" from your own catalog and policies.
- Send product photos and suggest items you actually sell.
- Take a cash-on-delivery order and send an order form.
- Answer "amar order kothay?" from your order records.
- Hand complaints, wholesale requests and anything unclear to your team.
- Reply in Bangla, English or [Banglish](https://salemag.net/glossary/banglish), whatever the customer uses.

And a few things it should not do, under the new rule or just as good practice:

- Act as a free general assistant on any topic.
- Pretend to be a human when a customer sincerely asks.
- Ask for card numbers, PINs or account passwords in chat.
- Send promotions to people who never opted in, AI-written or not.

## What should I check before 15 January 2026?

Check four things: that your bot's scope is your business, that a human escalation path exists, that your provider fits Meta's rules, and that your data use is clean. Each takes minutes.

1. **Scope.** Ask your bot an off-topic question, such as "write me a poem about rain". It should steer back to your shop. If it writes the poem, tighten its instructions.
2. **Escalation.** Type "I want to talk to a person" and its Bangla equivalent. The chat should reach a human, and someone on your team should get notified.
3. **Provider.** If you use a third-party tool, confirm it runs on the official WhatsApp Business API and that the bot is your customer service bot, not a general assistant.
4. **Data.** Do not export WhatsApp chats to train or improve a public AI model. If you are considering fine-tuning for your own use, read the current terms first.

## How does SaleMag's AI chatbot fit Meta's rules?

SaleMag's [AI chatbot](https://salemag.net/features/ai-chatbot) is a customer service and sales assistant for your own business. It answers from your own knowledge base of products, FAQs, files and web pages, and is instructed to state facts only from that content and your order records, never to invent prices, policies or links. It runs on WhatsApp through Meta's official WhatsApp Cloud API, using your own OpenAI, Anthropic (Claude) or Google Gemini key.

For escalation, the bot hands the chat to your team when the customer asks for a person, or when it cannot answer and "hand over when unsure" is on. Your team is notified, the chat switches to human mode, and the bot stays silent until an agent hands it back. Whether a particular setup meets Meta's terms is Meta's call, so keep your bot focused on your business.

## Update, October 2026: what has happened since?

The AI Providers rule took effect as planned on 15 January 2026, and section 4.7 is still in Meta's terms as of October 2026. Since then, Meta has made market-specific changes for general-purpose AI assistants, including exemptions or paid access in some countries after competition regulators stepped in. None of this changes the position for a Bangladeshi business using AI for its own customer service.

Two other changes are worth knowing. In mid-2026 Meta launched its own Meta Business Agent, an AI agent product for businesses, billed separately. And on 1 October 2026 Meta changed WhatsApp pricing: utility messages sent inside an open customer service window are charged again, and service messages are free only up to 1,000 per business phone number per month. Check Meta's [pricing page](https://developers.facebook.com/docs/whatsapp/pricing) for the current details, since AI replies count as messages like any other.

## Next steps

Run the four checks above on your current bot this week: an off-topic question, a request for a human, a look at your provider, and a look at your data use. ## FAQ

### Is Meta banning AI chatbots on WhatsApp in 2026?

No. Meta is banning general-purpose AI assistants offered by AI providers over the WhatsApp Business API from 15 January 2026. Businesses using AI chatbots for their own customer support and sales are not the target of the rule.

### Can my shop still use an AI chatbot on WhatsApp after 15 January 2026?

Yes. A shop chatbot that answers its own customers about its products, prices, delivery and orders uses AI as a supporting feature, which Meta's terms do not prohibit. It must still follow WhatsApp's Business Messaging Policy.

### Who is affected by Meta's WhatsApp AI provider rule?

Providers and developers of AI technology, such as large language model companies, whose AI assistant is the primary functionality being offered through the WhatsApp Business Platform. Public assistants that let anyone chat with a general AI on WhatsApp were the main examples.

### Does my WhatsApp AI chatbot need to offer a human?

Yes. WhatsApp's Business Messaging Policy says businesses may use automation but must have prompt, clear and direct escalation paths, such as transfer to a human agent, a phone number, email or a support form.

### Can my chatbot answer general questions unrelated to my shop?

It should not. Keep the chatbot limited to your business, products and customer service. A bot that answers anything on any topic looks more like a general-purpose assistant and also tends to give more wrong answers.

### Can I use WhatsApp customer chats to train an AI model?

Not freely. Meta's WhatsApp Business Platform terms say platform data may not be used to train AI systems in general, though a business may fine-tune a model for its own use as long as the data does not improve other models. Check the current terms before doing anything like this.

### Where can I read the official WhatsApp AI rule?

The rule is in section 4.7, 'AI Providers', of the [Meta Terms for WhatsApp Business Platform](https://www.facebook.com/legal/Meta-Terms-for-WhatsApp-Business-Platform). The escalation requirement is in the [WhatsApp Business Messaging Policy](https://whatsappbusiness.com/policy/).
